Must read: Justice seems destroyed as written by Balogun Idris Omobemi

I was under the ministration of Primate Tclaw last Friday at the Grand Finale of 2017 Breakthrough Night at Ogere Remo, when said, during his charge to the nation, "Justice should not only be done but should be seen to be done."  At first, I was stupefyingly taken aback because His Eminence is not close to being a legal practitioner, though widely read and versatile, to have known the classic age-long and repeated dictum of Lord Chief Justice Hewart in R v. Sussex Justices, Ex parte McCarthy (1924) 1 KB 256,  “It is not merely of some importance, but is of fundamental importance that justice should not only be done, but should manifestly and undoubtedly be seen to be done”.
Immediately, I asked myself, "Is Justice being seen to be done?" Not to talk of it being undoubtedly and manifestly seen to be done. Just like the answer on many lips, NO. where has Justice gone to? It's right there on the palms of its custodians. Why, then, has the confidence of the right minded people and that of the hopeless been destroyed? As Lord Denning MR would have put it in Metropolitan Properties Co (FGC) Ltd v. Lannon (1961)1 Q.B. 577; “The court will not inquire whether he did in fact, favour one side unfairly. Suffice in that reasonable people might think he did. The reason is plain enough. Justice must be rooted in confidence: and confidence is destroyed when right-minded people go away thinking: ‘The judge was biased’.” The above cited aphorisms are not restricted to Ministers in The Temple of Justice alone, it cuts across all spheres of life. At home, we see cases of parent perverting justice all in the name  of favoritism. It begins from here. A child brought up in such a condition won't take into cognizance of what justice stands for. Law Enforcement Agencies are not left out. They have turned themselves into oppressors who now administer justice at their own discretion, even without regards for the age-long rule of natural justice. The basic rules of justice have been very much there ever since the trial of the first man and first woman byGod in the garden of Eden. Even God gave Adam and Eve an opportunity of hearing, heardthem, noted their conducts, questioned them and after assessing the gravity of the wrong done by each one of them, condemned them to various sentences. Justice Fortescue was so charmed by the Biblical storyof how justice was administered even by God himself that he based his own judgment in Dr. Bentley's case (1723) upon it andobserved; "The objection for want of notice can never be got over. The lawsof God and man both give the party an opportunity to make his defence,if he has any."
So I returned and considered all the oppressions that are done under the sun: and behold the tears of such as were oppressed, and they had no comforter; and in the side of their oppressors there was power; but they had no comforter. The iron grip of oppressors, no one to rescue the victims from them. So, just like King Solomon, I congratulated the dead who are already dead instead of the living who are still alive. But luckier than the dead or the living is the person who has never ever been, who has never seen the bad business that takes place on this planet.  Fiat Justitia Ruat Coelum
